Concordat Commissioner Training Certificate Program

Program Objective:

Participants who complete the Concordat Commissioner Training Program will be able to carry out Concordat Commissioner duties in accordance with the relevant legislation, based on the knowledge and skills acquired during the training.

Eligibility for Participation:

Qualifications Required for a Concordat Commissioner
Article 4 – (1)
A commissioner must meet the following qualifications:
a) To be a citizen of the Republic of Türkiye.
b) To have full legal capacity.
c) To be a graduate of a faculty providing at least four years of undergraduate education, or of a domestic or foreign higher education institution whose equivalency is recognized by the Council of Higher Education (YÖK), and to have no less than five years of professional experience.
ç) Not to have been declared bankrupt.
d) Not to have been dismissed from the office of commissioner within the last three years due to failure to comply with the duty of care required by the position.
e) Not to have been dismissed from a profession or public office due to disciplinary reasons; not to be prohibited from practicing a profession or professional activity.
f) Not to be barred from public service.
g) Not to have any provision in the relevant legislation governing the profession currently practiced that would prevent the performance of commissioner duties.
ğ) Even if the periods specified in Article 53 of the Turkish Penal Code No. 5237 dated 26/09/2004 have elapsed, and even if a sentence of imprisonment exceeding one year has been imposed or pardoned for an intentional offense, not to have been convicted of crimes against the security of the state, crimes against the constitutional order and its functioning, as well as embezzlement, extortion, bribery, theft, fraud, forgery, abuse of trust, fraudulent bankruptcy, bid rigging, interference with the performance of obligations, laundering of assets derived from crime, smuggling, providing false expert opinion or translation, perjury, or false oath.
h) Not to have any affiliation or connection with terrorist organizations.
ı) Without prejudice to Article 13 of this Regulation, to have completed the commissioner training.

Duration of the Basic Concordat Training:
The basic training consists of at least thirty-six (36) course hours.
The training is provided by individuals holding the titles of Professor, Associate Professor, or Doctor in the fields of Civil Procedure and Enforcement & Bankruptcy Law, Civil Law, Commercial Law, Business Administration, Economics, Public Finance, and Accounting.

• General principles of enforcement and bankruptcy law
• Concordat legislation
• Qualifications required of the commissioner
• Duties, powers, and obligations of the commissioner, as well as legal and criminal liability
• Concordat project
• Creditors’ committee and its duties
• Business management
• Analysis of financial reports
• Crisis management in enterprises
• Report writing methods and techniques
• Other topics deemed necessary by the Presidency

Validity of the Concordat Certificate:

Article 11 –
(1) Commissioners shall receive refresher training once every three years, with a total duration of not less than twelve hours, provided by institutions authorized to offer such training.
The commissioner is required to attend the refresher training within the third year following the date of registration on the list.
Commissioners who fail to complete the refresher training shall not be re-registered on the list.

Refund Policy:
No refunds shall be made as of one day prior to the commencement of the training, regardless of any excuse.
